Description

The National Inmate Survey (NIS) is part of BJS's National Prison Rape Statistics Program, which gathers mandated data on the incidence and prevalence of sexual assault in correctional facilities under the Prison Rape Elimination Act of 2003 (PREA; P.L. 108-79). PREA requires a 10% sample of correctional facilities to be listed by incidence of sexual assault, with a minimum of one prison and one jail facility in each state. Data are collected directly from inmates in a private setting using audio computer-assisted self-interview (ACASI) technology with a touchscreen laptop and an audio feed to maximize inmate confidentiality and minimize literacy issues. 2023–24 National Inmate Survey (NIS) data were collected separately in local jails and state and federal prisons and will be reported separately. BJS plans to release findings across a series of reports in 2025 and 2026.

For local jails—

  • Sexual Victimization in Local Jails Reported by Inmates, 2023–24 includes national- and facility-level estimates of sexual victimization in local jails.
  • Characteristics of Sexual Victimization in Local Jails Reported by Inmates, 2023–24 – Statistical Tables describes victim, perpetrator, and incident characteristics of sexual victimization in local jails. BJS expects to publish this report in Summer 2025.
  • Facility Characteristics of Sexual Victimization of Inmates in Local Jails, 2023–24 – Statistical Tables describes characteristics of local jails related to inmate-reported sexual victimization. BJS expects to publish this report in 2026.

For state and federal prisons—

  • Sexual Victimization in State and Federal Prisons Reported by Inmates, 2023–24 includes national- and facility-level estimates of sexual victimization in state and federal prisons. BJS expects to publish this report in Fall 2025.
  • Characteristics of Sexual Victimization in State and Federal Prisons Reported by Inmates, 2023–24 – Statistical Tables describes victim, perpetrator, and incident characteristics of sexual victimization in local jails. BJS expects to publish this report in Winter 2025-26.
  • Facility Characteristics of Sexual Victimization of Inmates in State and Federal Prisons, 2023–24 – Statistical Tables describes characteristics of state and federal prisons related to inmate-reported sexual victimization. BJS expects to publish this report in 2026.
