Chapter 23-5 of the South Dakota Code focuses on criminal identification information. It contains provisions on its procuring and filing by the State attorney general, cooperation of the attorney general with law enforcement officers to establish a complete State system, and the procuring and filing of criminal records of inmates. Sections on access to criminal history information encompasses the examination of one's own criminal history information and criminal record check by schools or child welfare agencies on prospective employees. Chapter 23-6 of the South Dakota Code covers criminal statistics. Sections pertain to the establishment of the Bureau of Criminal Statistics and its responsibilities; destruction of records of certain persons, incidents, and offenses; and the dissemination of information on misdemeanors. Chapter 127 addresses public records and files and the parameters for making them accessible to those seeking the information they contain.
