Description of original award (Fiscal Year 2022, $422,901)

The South Carolina Law Enforcement Division (SLED) serves as the point of contact to the Federal Bureau of Investigation National Instant Criminal Backgrounds Check System (FBI NICS).  One of the largest categories of the NICS Index are persons adjudicated as mental defectives, as defined under US Code of Law, Title 18 922 (g)(4).  S.C. Code Ann. §23-31-1020 mandates Probate and Circuit Courts to provide court ordered mental health adjudications to SLED for submissions into the Index. SLED received a federal funding to create the SLED NICS Unit, to include and electronic document management system (EDMS) and a single point of entry interface with the FBI NICS Indices. These funds have been successfully utilized to implement processes and dedicate personnel to entering mental health records from state courts into the NICS Indices as well as other prohibitors under US Code of Law, Title 18 922 (G) & (N). As of March 31, 2022, SLED has entered approximately 109,722 mental health adjudications into the NICS Indices, making 133,713 total records residing in the NICS Indices. Funding for this project is required to continue the progress made with the technical personnel assigned to administering and maintaining the EDMS in order to ensure that all mental health adjudication orders are entered into NICS Indices in the time specified by the S.C. Code of Laws.
