Corrections

Corrections refers to the supervision of persons arrested for, convicted of, or sentenced for criminal offenses. Correctional populations fall into two general categories: institutional corrections and community corrections. Corrections data, with a few exceptions, covers adult agencies or facilities and adult offenders.

BJS maintains over 30 corrections-related data collections. Most are annual collections of administrative data from correctional administrators, ranging from basic population counts and offender demographic characteristics to facility capacity, programs, staff, and resources. These data collections include—

National Prisoner Statistics (NPS) Program - administrative data on state and federal prisoners, collected twice a year
Annual Survey of Jails (ASJ) - administrative data on jail populations
Annual Probation Survey and Annual Parole Survey - administrative data on offenders under community supervision
National Corrections Reporting Program (NCRP) - administrative data on admissions to and releases from state prisons, collected annually from participating state jurisdictions
Census of Jails and Census of State and Federal Adult Correctional Facilities - administrative data on facilities and staff, collected periodically
Justice Expenditures and Employment Extracts (JEEE) - administrative data on federal, state, and local government expenditures and employment for corrections activities.
Survey of Sexual Victimization (SSV) – administrative data on allegations and substantiated incidents of sexual victimization in correctional facilities (PREA).

The NPS also collects counts on specific inmate populations from the Department of Defense (DoD) and the U.S. territories. Some limited information on the number of juveniles held in adult facilities is also collected in the NPS and the ASJ. Jails in Indian Country is a separate collection for data on counts and characteristics of persons held in tribal jails. BJS also tracks administrative data on other topics, such as HIV in correctional facilities; sexual assault in correctional facilities; and capital punishment statutes, populations, and executions.

In addition to collecting administrative data, BJS maintains a number of recurring national surveys of prison and jail inmates. These surveys are conducted periodically and use a nationally representative sample of inmates. The surveys, Survey of Prison Inmates (formerly known as the Survey of Inmates in State and Federal Correctional Facilities) and the Survey of Inmates in Local Jails, are broad in scope and collect a wide range of data on the personal and criminal histories of criminal offenders. Topics cover childhood experiences, family structure, educational background, prior criminal activity, substance abuse experiences, mental and physical health problems, and conditions of current confinement. Estimates derived from these surveys are national and, with rare exceptions, are not available at the state or facility level.

BJS began to collect mortality data from state prisons, local jails, and local and state law enforcement agencies in 2000 in response to the Congressional enactment of the Death in Custody Reporting Act (DICRA, P.L. 106-297). Through its Mortality in Institutional Corrections (MCI) collection, BJS obtained data on deaths that occurred in the custody of local jails from 2000 to 2019 and state prisons from 2001 to 2019. Deaths that occurred in the process of arrest by law enforcement agencies were collected from 2003 to 2009, and a redesigned methodology was tested in 2015 and 2016.

Federal agencies were not included in the 2000 DICRA law, but BJS collected summary statistics on persons who died in the custody of the Federal Bureau of Prisons (BOP) through 2014. After the reauthorization of DICRA in 2013 (P.L. 113-242), which included a requirement to collect data from federal agencies, BJS began obtaining individual-level death data from the BOP, as well as from other federal agencies with law enforcement responsibilities.

The 2013 DICRA reauthorization expanded the original 2000 law to include additional enforcement and compliance requirements for local and state law enforcement agencies, jails, and prisons. As a federal statistical agency and consistent with its authorizing legislation, BJS may only use the data it collects or maintains under its authority for statistical purposes, which excludes enforcement and compliance activities. Consequently, the Department of Justice (DOJ) determined that BJS's MCI collection did not meet the 2013 DICRA requirements. DOJ decided that it would be more appropriate for the Bureau of Justice Assistance (BJA) to administer the program and collect mortality data for DOJ starting with quarter 1 (Q1) of fiscal year (FY) 2020 (October to December 2019). State departments of corrections (DOC), local jails, and law enforcement agencies will now report their death information on a quarterly basis to centralized state agencies, who will compile and submit this to BJA to comply with all applicable DICRA requirements. Federal agencies, including the BOP, will continue to report deaths that occur in their custody to BJS.

BJS created the Federal Deaths in Custody Reporting Program (FDCRP) to collect the data required of federal law enforcement agencies. Federal law enforcement agencies are surveyed on an annual basis about deaths that fall under the scope of DCRA. Terms & Definitions

Community corrections

The supervision of criminal offenders in the resident population, as opposed to confining offenders in secure correctional facilities. The two main types of community corrections supervision are probation and parole. Community corrections is also referred to as community supervision.

Custody

To have custody of a prisoner, a state or the Federal Bureau of Prisons (BOP) must physically hold that person in one of its facilities. A locality, state, or the BOP may hold inmates over whom a different government maintains jurisdiction.

Federal prisons

Prison facilities run by the Federal Bureau of Prisons (BOP). Prisoners housed in these facilities are under the legal authority of the federal government. This excludes private facilities under exclusive contract with BOP.

Operational capacity

The number of inmates that can be accommodated based on a facility's staff, existing programs, and services.

Prisoners

Prisoners are inmates confined in long-term facilities run by the state or federal government or private agencies. They are typically felons who have received a sentence of incarceration of 1 year or more. (Sentence length may vary by state because a few states have one integrated prison system in which both prison and jail inmates are confined in the same types of facilities.)
